British man fined for son's death at Cyprus hotel
Overview
Joshua Foster, a 37-year-old British auditor, has been sentenced to a 3,000 euro fine by the Paphos District Court after pleading guilty to causing death through a reckless, rash, or dangerous act. The conviction follows the death of his three-year-old son at the King Evelthon Beach Hotel and Resort in Chlorakas, Cyprus.
The incident occurred on July 12 while the family was on holiday. Foster placed his son on a fourth-floor windowsill to show him a view of a nearby waterpark, believing the opening was secured by a glass pane. The child fell approximately 12 meters through an open section of the window. Although the child was taken to Paphos General Hospital, he could not be resuscitated.
During sentencing, Judge Froso Christodoulidou ruled that a prison sentence was not warranted. The judge cited Foster’s guilty plea, his cooperation with authorities, his lack of a prior criminal record, and the fact that the tragedy was a “momentary lapse” rather than an act of intentional harm. The judge further noted that the window lacked markings to indicate it was open. While the defense characterized the event as a “momentary lapse in judgment” and a “tragic accident,” the judge noted that the loss would follow the family for the rest of their lives. The prosecution noted a slightly elevated blood alcohol level but did not allege drunkenness. Foster was permitted to return to the UK to be with his remaining family. The sentencing was finalized on October 16.
