Federation of BiH Sunday retail work regulations
Overview
The implementation and potential revision of laws regarding non-working Sundays in the Federation of Bosnia and Herzegovina (FBiH) remain a subject of political and economic debate. While some political parties have advocated for changes, Federal Minister of Trade Amir Hasičević has defended the current law, citing Tax Administration data that shows no decline in total turnover, but rather a redistribution of consumer activity. Some critics argue the measure causes economic issues, particularly in border areas near Republika Srpska.
In the Herzegovina-Neretva Canton, Minister of Trade, Tourism, and Environmental Protection Emil Balavac has reaffirmed that the ban remains in effect under the Internal Trade Law, which came into force in November 2024. Balavac stated that inspections aim to “ensure legal compliance, protect workers' rights, and maintain fair competition for law-abiding traders,” describing the non-working Sundays as a “significant advancement for retail employees.”
Enforcement actions in late 2024 revealed varying levels of compliance. In the Mostar area, inspections on November 17 found violations in 15 establishments, resulting in 29 fines totaling 35,500 KM, though subsequent inspections on November 24 showed full compliance. On November 25, Statehood Day, 13 entities were found in violation, leading to 23 fines totaling 26,500 KM.
Parallel discussions regarding labor regulations have also emerged. Under the FBiH Labor Law, workers may hold multiple contracts, such as part-time employees entering additional agreements to reach full-time hours. However, full-time employees must navigate specific legal frameworks, including potential non-compete clauses under Article 85 of the Labor Law.
