Germany tightens transparency and intelligence powers

Overview

In early July 2026 Germany’s governing coalition approved amendments to the Freedom of Information Act (IFG) that would narrow access to natural persons, require proof of legitimate interest, limit requesters to German or EU citizens, raise fee ceilings and exclude many NGOs and media organisations. A broad alliance of NGOs, journalists’ unions, Amnesty International, Human Rights Watch, publishers and SPD members criticised the measures as an erosion of transparency and press freedom. By late July Interior Minister Alexander Dobrindt announced a sweeping overhaul of the country’s intelligence services, linking the changes to further tightening of the IFG. The draft law raises the threat level to “high”, expands powers to counter perceived foreign espionage, and proposes eliminating the historic separation between the Federal Office for the Protection of the Constitution (BfV), the BND and the MAD. Parallel proposals would restrict parliamentarians’ and journalists’ access to government data, remove online portals such as FragDenStaat and introduce an identification requirement for requesters. On 23 July Die Linke’s deputy parliamentary group leader Clara Bünger warned that the plan includes abolishing the Federal Commissioner for Information Freedom, effectively ending a key oversight body and shutting down portals such as Frag den Staat. On 24 July Dobrindt announced plans to give the BfV police‑like authority; the following day he reiterated the proposal, prompting former BfV president Hans‑Georg Maaßen to condemn the politicisation of the agency as a threat to Germany’s liberal democratic order. Data‑protection commissioner Louisa Specht‑Riemenschneider then warned that the reform would grant the BND and BfV access to public video‑surveillance feeds, including audio and real‑time images, and allow indefinite storage of personal data. She called the measures unconstitutional and cautioned that the Federal Constitutional Court could intervene.
