India airline fare regulation development
Overview
The Indian government has moved to regulate airfares and additional charges following legal challenges regarding “opaque, exploitative and algorithm-driven” pricing practices. In October 2026, the Centre informed the Supreme Court that new rules under the Bharatiya Vayuyan Adhiniyam, 2024, had received administrative approval and would be published within two weeks to address surge pricing and baggage charges.
By November 2026, the government officially notified the “Indian Aircraft Rules, 2026,” which are scheduled for implementation on January 1, 2027. These regulations replace the outdated “Aircraft Rules, 1937” and aim to modernize air travel oversight. Under this framework, airlines may set prices based on market demand and operational costs, such as fuel prices, without a specific price ceiling. However, the government retains the authority to intervene through written instructions during extraordinary circumstances or in the interest of public welfare, provided such actions are proportional and limited to a specific timeframe.
The upcoming Bharatiya Vayuyan Niyam, 2026, will consist of 220 rules covering aircraft design, certification, personnel licensing, and aerodrome operations. To strengthen India’s position as a State of Design, the rules include a framework for aircraft design and component manufacturing. Additionally, the introduction of fractional ownership models and coordination with the Protection of Interests in Aircraft Objects Act, 2025, aim to facilitate aircraft leasing and deregistration to reduce acquisition costs and ease pressure on airfares.
Amidst these developments, the Supreme Court of India declined an urgent hearing regarding a petition over festival airfares that reportedly increased by nearly 700 percent. During the proceedings, the bench observed, “Don’t travel by air,” a remark that has drawn criticism from citizens who argue that air travel is an essential service.
