Overview

Tensions have escalated between Italian authorities and German non-governmental organizations (NGOs) regarding Mediterranean migrant rescue operations. Initially, German NGOs such as Sea Watch and SOS Humanity defended their missions against a proposed Italian ‘compensation mechanism’ that would require German-flagged vessels to return rescued migrants to Italy. These organizations argued that rescue is a legal obligation and criticized the Italian government for attempting to criminalize humanitarian efforts.

Following a rescue operation on August 13 in international waters involving six people, Italian authorities imposed a 7,500 euro fine and a 45-day administrative detention on the Sea Watch 5 after it docked in Naples. Interior Minister Matteo Piantedosi announced the sanctions, citing a “grave violation of regulations” and a failure to coordinate the rescue with the Libyan maritime rescue coordination center. Italian authorities maintain that rescue activities must be managed by sovereign states rather than private organizations.

Sea Watch has strongly contested the decision. Spokesperson Giulia Messmer noted that the Italian maritime rescue coordination center never requested notification to Libya and claimed the Libyan coastguard was actually in radio contact with the crew during the operation. The NGO continues to describe the Libyan coordination center as a “puppet authority” used to legitimize human traffickers. Sea Watch also documented eight bodies in the Mediterranean during the journey to Naples and reported that an unidentified Libyan vessel approached the crew with firearms.

The incident has reignited a broader diplomatic dispute. German political figures, including members of the CDU/CSU and AfD, have argued that such NGO operations encourage dangerous crossings and assist smuggling networks by bringing individuals to European ports instead of returning them to Libya.
