Mexico beverage and tobacco tax reform developments
Overview
The Mexican Chamber of Deputies continues to discuss modifications to the Special Tax on Production and Services (IEPS) for flavored beverages. While previous debates focused on the equity of fixed rates for smaller cooperatives like Pascual, new proposals suggest replacing the current ad valorem scheme with a fixed rate of 1.38 pesos per degree of alcohol per liter. The Centro de Investigación Económica y Presupuestaria (CIEP) estimates this specific change could reduce beer prices by approximately 5.1 percent and increase consumption by 6.2 percent, if savings are passed to consumers. The proposal also includes a 90 percent tax incentive for artisanal producers and importers, though critics express concerns regarding potential decreases in tax revenue.
Regarding consumption trends, Health Secretary David Kershenobich announced that Mexico recorded a historic 2.2 percent decrease in soda consumption between January and May 2026. This marks the first observed downward trend in sugary beverage consumption in the country. Authorities attribute this decline to public health measures, such as the removal of junk food from elementary schools, which has achieved 97.3 percent coverage across 83,713 schools. Additionally, health officials reported a 7.1 percent reduction in tobacco consumption during the same period, supported by reinforced front-of-package warning labels.
In response to fiscal policies, the Mexican tobacco industry is urging the Ministry of Finance to cancel a proposed 8 percent tax increase on cigarettes for 2027. Gastón Zambrano Margain, president of the National Council of the Tobacco Industry (CONAINTA), argued that high taxes have failed to reduce smoking rates or combat smuggling. Industry representatives claim current policies fuel organized crime and an illegal market that accounts for an estimated 23% to 28% of national consumption, with annual tax evasion projected between 23 billion and 26.7 billion pesos.
