Poland labor law updates: mobbing, sick leave, and insurance

Overview

The Polish labor landscape is undergoing significant regulatory shifts. Regarding workplace harassment, a new definition of mobbing is set to take effect on November 5, 2026. This definition focuses on persistent, repetitive, or constant harassment, clarifying that single incidents do not qualify. Notably, the law removes the requirement for claimants to prove a perpetrator’s intent or specific health damage to seek compensation. Employers must update their internal regulations by May 2027.

In the realm of sickness insurance, the Ministry of Family, Labour and Social Policy has proposed changes to benefit employees with multiple income sources. The project aims to allow individuals to opt into sickness insurance through a second contract, such as a mandate contract, alongside a standard employment contract. This could entitle workers to higher benefits through voluntary contributions. However, a major shift is scheduled for January 1, 2027, when doctors will be restricted to issuing medical certificates (L4) for only one insurance title, affecting those working multiple roles.

Ongoing enforcement of sick leave (L4) regulations continues to impact small and medium-sized enterprises (SMEs). Since the April 13 implementation of rules allowing employers with up to 20 employees to independently request inspections, Conperio data shows a 42 percent increase in such controls among SMEs compared to the first quarter of the year. These inspections have identified irregularities in approximately 36 percent of cases, including employees engaging in manual labor, recreational travel, or secondary employment while on leave. Despite these tools, many micro and small business owners remain unaware of their rights, which can disrupt workflows and revenue in small teams.
