Spain pharma reforms, generic uptake and pricing debate

Entities: Royal Decree on financing and pricing of medicines · Elena Casaus · Spain · Spanish Ministry of Health · Asociación Española de Medicamentos Genéricos (AESEG)

Overview

Spain’s health‑system reforms continue to reshape pharmaceutical financing and market access. The tiered co‑payment system introduced in May 2026 and the health‑technology‑assessment decree aligning review with EU HTA rules have reduced the median gap between EU authorisation and public funding to 474 days, with 76.5 % of the 221 EU‑authorised innovative medicines now reimbursed. A July report on generic, hybrid and biosimilar uptake showed biosimilars accounting for 81.5 % of packs in competitive markets, hospital biosimilar varieties expanding from 14 to 22 molecules and oncology biosimilars capturing over 90 % of that segment. Hospital pack volumes rose from 19.8 million to 31.4 million, while pharmacy dispensing increased markedly. Concurrently, the Council of Ministers enacted the Medicines and Medical Devices Law, replacing the 2015 framework and introducing a dynamic pricing model for off‑patent drugs, a definition of "strategic medicines" to safeguard supply, early‑access mechanisms for innovative treatments, stronger reporting obligations for manufacturers and distributors, and an independent evaluation system to protect the public‑health budget’s sustainability. The Spanish Association of Generic Medicines (AESEG) has warned that the draft Royal Decree on financing and price setting does not curb the continual erosion of generic prices, lacking an explicit cap on reductions and risking market entry and supply continuity. The association urges safeguards to prevent commercial unviability of essential medicines.
