U.S. efforts to dismantle the International Criminal Court
Overview
U.S. Secretary of State Marco Rubio is leading an initiative to dismantle the International Criminal Court (ICC), characterizing the institution as a “standing world tribunal with near-unlimited reach” that poses a threat to national sovereignty.
In response to ICC investigations into alleged U.S. war crimes and the pursuit of an arrest warrant for Israeli Prime Minister Benjamin Netanyahu, the U.S. administration has implemented several measures to undermine the court’s authority. These actions include imposing sanctions on ICC President Tomoko Akane and senior trial lawyer Abdoulaye Seye, as well as applying diplomatic pressure on allies to withdraw from the ICC. Additionally, the U.S. has withdrawn from the United Nations Human Rights Council.
Expanding this campaign, Rubio has threatened to abolish the ICC entirely if it does not cease what he describes as threats against American citizens. Labeling the institution a “rogue court,” Rubio stated in a video message that the United States will prohibit transactions with the ICC and withhold resources to prevent it from acting against Americans. He warned that if allies do not restrain the institution, the U.S. will continue to dismantle the ICC “piece by piece.”
Recent sanctions against the ICC have drawn international condemnation. Haris Tzimetras, Foreign Affairs Spokesperson for EL. A. S. Tzimetras, described the U.S. decision as “reprehensible and extremely dangerous,” warning that undermining international judicial institutions threatens global legality and allows power to supersede international law.
