Overview
Brazil has implemented and clarified various income tax regulations affecting different taxpayer categories. For minimum wage earners, while generally exempt from filing due to income thresholds, mandatory declaration is triggered by specific conditions. These include possessing assets exceeding R$ 800,000, receiving exempt income such as inheritances or donations over R$ 200,000, engaging in stock market activities, or meeting specific rural income limits. Newer regulations under Law No. 15.270, effective January 2026, have modified the taxation of dividends and foreign assets. Dividends distributed by Brazilian companies are no longer universally exempt; a 10% withholding tax applies if a single company distributes more than R$ 50,000 to an individual in one month. Furthermore, individuals with annual incomes exceeding R$ 600,000 are subject to a minimum taxation regime. Regarding foreign holdings, the Receita Federal clarified through Consultation Solution Cosit No. 138 that dividends and interest on equity cannot be excluded when updating assets to market value under Law No. 14.754/2023. While an 8% tax rate applies to the difference between acquisition cost and market value, certain deductions for controlled entities abroad are prohibited for this specific calculation. For the 2026 IRPF cycle, the Receita Federal expects approximately 44 million declarations. Tax refunds are scheduled for distribution in four monthly installments from May 29, 2026, to August 31, 2026. Priority is given to individuals aged 80 or older, those aged 60 or older, persons with disabilities, or those with serious illnesses, as well as education professionals and those using pre-filled forms with a Pix key. The government has authorized automatic refunds up to R$ 1,000.00 for exempt citizens with a regular CPF and registered Pix key. Taxpayers may face ‘malha fina’ (tax audits) due to inconsistencies in medical expenses, dependents, or investment income.
