BRICS+ judicial cooperation forum in India

Overview

The 11th BRICS+ Legal Forum in New Delhi convened senior judicial leaders from member and partner states to strengthen international legal cooperation. Chief Justice of India Surya Kant introduced ‘Nyaya-nomics’, arguing that economic growth relies on trusted institutions and consistent adjudication to reduce transaction costs. He further emphasized that efficient commercial courts are vital for fostering foreign investor confidence.

During the three-day event, judicial leaders engaged in discussions regarding mediation, arbitration, and the integration of artificial intelligence in justice delivery. Bilateral meetings were held to explore Memoranda of Understanding for judicial cooperation and the mutual recognition of judicial awards. Specifically, Belarus Supreme Court Chairman Andrei Shved met with judicial leaders from Iran and Russia to discuss legal assistance in civil and criminal matters, as well as the digitalization of court processes.

In specialized sessions, the Iranian judiciary highlighted efforts to design new legal mechanisms and address perceived violations of Iranian rights attributed to Israel and the United States. Nasser Seraj, Deputy for International Affairs of the Iranian judiciary, discussed the potential for BRICS nations to create a new model for cooperation despite their diverse legal systems. He noted the importance of the 1958 New York Convention in establishing standards for the recognition and enforcement of foreign arbitral awards to ensure predictable dispute resolution in international trade.
