Justice Senyo Dzamefe ruled that the application did not disclose a serious case to be tried and noted that the issues were more appropriate for an appeal, finding that the High Court judge had not exceeded his jurisdiction.

Following this dismissal, the High Court has scheduled September 23 for the accused to file their defense. Meanwhile, Professor Ameyaw-Akumfi has filed a separate application for a stay of proceedings, which is expected to be heard by the Court of Appeal on September 1, 2026. Both accused men deny the charges.
