Illinois medical cannabis regulatory updates

Overview

Following the signing of Senate Bill 3222, Illinois has implemented new regulations regarding medical cannabis. The updated law allows adult-use dispensaries to opt into medical cannabis licensing at a reduced tax rate and permits healthcare providers to issue certifications without in-person examinations.

Subsequent guidance from the Illinois Department of Agriculture has clarified facility requirements, distinguishing between structural ‘Modifications’ and non-structural ‘Alterations’ to security or equipment. Licensed entities must also ensure staff complete the Responsible Vendor Program within 90 days of license issuance.

The Illinois Department of Public Health (IDPH) has expanded the program by increasing the number of qualifying debilitating conditions to 58, adding sickle cell disease and polyendocrine metabolic ovarian syndrome (PMOS) with chronic pain to the approved list.

As of September 10, 2026, the Illinois Department of Financial and Professional Regulation (IDFPR) has begun issuing medical cannabis dispensary licenses to existing adult-use dispensaries. This marks the first expansion of the state’s medical cannabis program since its 2014 inception. Approximately 40 of the state’s 220 adult-use dispensaries have opted into the program, allowing them to serve both medical patients and adult-use customers at the same site. Under these regulations, registered patients can access medical cannabis tax rates that are ‘24% to 40% lower than adult-use taxes.’ Operators such as nuEra Cannabis have announced they will begin serving medical patients at locations in Champaign, DeKalb, East Dubuque, Aurora, and Harvey.
