Overview

Following the appointment of permanent leadership across all 25 Indian High Courts, the Supreme Court Collegium, led by Chief Justice of India Surya Kant, has moved forward with further judicial elevations. On September 28, 2026, the Collegium recommended the elevation of three High Court Chief Justices to the Supreme Court: Justice Sunita Agarwal (Gujarat High Court), Justice Devendra Kumar Upadhyaya (Delhi High Court), and Justice Aparesh Kumar Singh (Telangana High Court). On October 5, 2026, Chief Justice Surya Kant administered the oath of office to these three new judges, increasing the Supreme Court’s working strength from 34 to 37. This brings the court to within one position of its sanctioned strength of 38, which was recently increased via the Supreme Court Amendment Act, 2026. The appointment of Justice Sunita Agarwal increases the total number of women serving on the Supreme Court to three, joining Justice B V Nagarathna and Justice Venkita Subramani Mohana. In a separate legal development, the Supreme Court has agreed to examine a plea seeking to recall a recent split verdict regarding the 2023 Act governing the appointment of the Chief Election Commissioner (CEC) and other Election Commissioners.
