Opposition to surrogacy in Poland has intensified following reports of foreign clinics, such as the Ukrainian-based BioTexCom, targeting Polish clients.

The Polish Federation of the Life Defense Movement initially raised concerns that commercial surrogacy treats women as “reproductive tools” and children as “objects of legal contracts.” The Federation also questioned whether Polish infertility clinics might facilitate foreign surrogacy programs through procedures like egg retrieval or embryo transfer conducted domestically.

Following these concerns, the Bioethics Expert Team of the Polish Episcopal Conference (KEP) issued a formal position describing surrogacy as “inherently immoral” and incompatible with Christian faith. The KEP characterized surrogacy conducted abroad as having the characteristics of “international human trafficking,” asserting that children are being treated as commodities. The KEP experts further argued that conception and birth should not be subjects of commercial transactions and called on state authorities to prevent surrogacy for Polish citizens.

Legal and administrative complexities have emerged regarding the transcription of foreign birth certificates. The Ministry of Interior and Administration stated that civil registry officials do not conduct investigative proceedings to verify a mother’s identity or a child’s origin when transcribing certificates from jurisdictions like Ukraine, where the surrogate is omitted.

Pressure from social and legal protests has directly impacted BioTexCom’s activities in Warsaw. After the venue provider, Centrum Żoliborz, refused to rent space to the clinic, a planned promotional conference was relocated. This refusal followed warnings from the Life and Family Foundation regarding legal risks. Joint opposition has been voiced by Human Life International Polska and the Ukrainian foundation ‘O Godność Człowieka’, who argue the practice leads to the objectification of women and children. Additionally, the Ordo Iuris Institute has petitioned the Polish Minister of Justice and the Prosecutor General for intervention.
