The case follows a Court of Appeal ruling that requires overseas emissions to be considered and comes as the Minns government has approved its 11th coal project in NSW. During the hearing it was revealed that the mine‑exit strategy mandated by the NSW Department of Planning was never produced. An independent audit in 2022 could not locate the strategy, and the condition was quietly removed when an 18‑month extension was approved in April 2025. The Lock the Gate Alliance, citing national coordinator Georgina Woods, accused Glencore and the planning department of colluding to delete the requirement and urged the company to fund a fair transition for workers and the broader Hunter region. HVO’s Foster rejected the claim that the company does not care for its workers, stating that consent obligations are only a starting point. By late July 2026, the Commission opened the final round of public submissions, set to close within days.
