Overview

Indonesia is moving to reform its upstream oil and gas sector by replacing the Special Task Force for Upstream Oil and Gas Business Activities (SKK Migas) with a permanent Special Business Entity (BUK Migas). This legislative effort, involving a revision of Law No. 22 of 2001, seeks to fulfill a 2012 Constitutional Court mandate requiring a permanent legal entity to manage national natural resources.

As the Indonesian House of Representatives (DPR RI) discusses the Oil and Gas Bill (RUU Migas), the proposed BUK Migas could hold mining and upstream business authority, potentially replacing SKK Migas functions and merging activities currently managed by Pertamina Hulu Energi (PHE). Beyond the BUK, Commission XII member Eddy Soeparno stated the bill includes provisions for an Oil and Gas Balance (Neraca Migas), an Oil and Gas Fund (Dana Migas), and measures to strengthen domestic energy security and sustainability.

The revision has drawn scrutiny from various stakeholders. Energy policy observer Sofyano Zakaria has warned that the new design must not diminish the strategic role of PT Pertamina (Persero), cautioning that relegating it to a “standard contractor role rather than a national energy instrument” could weaken national energy security. Similarly, industry observer Barry Pratama emphasized that the revision must prioritize legal certainty to attract investment and cautioned against placing excessive burdens on Pertamina through government assignments.

Concurrently, the SKK Migas Workers Union (SP SKK Migas) has elected Aldy Amir as its chairman for the 2026–2028 term. The union is seeking communication with the DPR RI to ensure workers' rights and job security are addressed during the legislative process.
