Following the October 4 municipal elections, legal disputes regarding the Lima mayoralty have intensified. While exit polls from Datum Internacional placed Rafael López Aliaga, the Renovación Popular candidate for first councilman, in the lead with 31.2%, the legitimacy of his potential ascension remains contested.

López Aliaga has defended his position, arguing that while the Constitution prohibits mayoral reelection, it does not bar him from running for the office. He asserted that if the National Jury of Elections (JNE) denies him the credentials for mayor, it would constitute a ‘presunto caso de prevaricato’ (alleged prevarication).

Opposing candidates continue to challenge the legal framework of the election. Daniel Urresti, the Podemos Perú candidate, labeled the JNE ‘inepto’ and ‘intrascendente’ (inept and insignificant) for failing to provide clarity on who would assume the mayoralty. Urresti maintained that López Aliaga’s candidacy is ‘inconstitucional’ due to reelection restrictions.

Prior to the vote, Somos Perú candidate Carlos Bruce had also challenged the JNE, citing a lack of definition regarding municipal credentials and expressing concerns that constitutional incompatibilities might only be determined after the election, potentially resulting in credentials being granted to different list members.
