AHMSA acquisition fails; Cargill-Afirme consortium advances

Overview

The auction process for Altos Hornos de México (AHMSA) and Minosa assets has collapsed following a failed attempt by Construcciones e Ingenierías Electromecánicas (CIESA) to secure the company.

Despite a $1.4 billion USD bid, CIESA failed to meet the October 13 deadline to deposit the required $56.3 million USD seriousness guarantee. Instead, the bidder reportedly deposited only 5,000 Mexican pesos. In response, Judge Ruth Haggi Huerta García of the Second District Court in Bankruptcy Matters rejected a request for a 90-day extension and referred the case to the Attorney General's Office (FGR). The judge cited a “lack of formality and bad faith” and ordered an investigation into potential crimes involving false statements under the Federal Penal Code.

The failed bid has intensified uncertainty for workers in the Centro and Carbonífera regions. This follows earlier warnings from Tereso Medina of the Confederación de Trabajadores de México (CTM), who urged caution and cautioned against treating the $1.4 billion USD offer as a definitive fact.

Parallel legal challenges continue to plague the CIESA representative, José Arturo Domínguez Arteaga. Arizona-based Natures Agrimate LLC has accused him of breaching an international binding agreement related to a $6 billion USD investment fund. The firm alleges that Domínguez Arteaga failed to provide a required $600 million USD initial contribution and has since ceased communication, stalling the financial structure intended for the industrial reactivation of the Coahuila steel sector.

Following the CIESA failure, a judge is now working to implement a sale alternative involving a consortium of Cargill and Afirme. While union leaders view the potential entry of Grupo Afirme representatives into the facilities as a positive step toward inspecting equipment, they have warned against the unauthorized removal of machinery. The court has established a 90-day period to advance the resolution, with progress reports required every 15 days.
