A procedural impasse also persists: the FGC requires BRB’s 2025 and 2026 financial statements to evaluate the capital injection, while Governor Leão maintains such documentation can only be finalized after the bank is capitalized. Minister Fux emphasized that the Judiciary will not force the Treasury to act as a guarantor or compel the FGC to provide the loan. Finance Minister Dario Durigan has defended the federal government against accusations of inertia, describing such claims as ‘a great injustice and irresponsibility.’ He noted that while the Union cannot legally act as a direct guarantor, the government is working through the AGU and PGFN to structure alternative security measures to provide more secure guarantees to participating private institutions. The crisis stems from the November 2025 extrajudicial liquidation of Banco Master, which uncovered R$5.7 billion in atypical credit transfers to BRB. BRB estimates approximately R$8.8 billion in non-recoverable or fraudulent credits.
