Overview
President Claudia Sheinbaum has introduced a constitutional reform initiative to the Mexican Congress aimed at restricting dual nationality for high-ranking officials. The proposal seeks to amend Articles 82, 116, and 122 of the Constitution, requiring candidates for President, Governor, or Head of Government of Mexico City to renounce any foreign citizenship before formally registering their candidacy with the National Electoral Institute (INE) or local electoral bodies.
Under the proposed rules, officials in these positions would be prohibited from acquiring new nationalities or using foreign passports to seek diplomatic protection from other states. Additionally, presidential candidates would be required to have resided in Mexico for at least 20 years. Sheinbaum stated the measure is intended to prevent foreign interference and ensure national interests remain the priority. Legal advisor Luisa María Alcalde Luján noted that current provisions in Article 32 have led to ‘interpretative confusion regarding dual citizens.’
The initiative also includes plans to reform the Law of Nationality to establish formal procedures for renouncing a second citizenship. The proposal aims to close legal ambiguities that have allowed individuals with dual citizenship to hold high executive positions.
Political opposition has intensified. The Institutional Revolutionary Party (PRI) has expressed categorical opposition to the initiative. Party President Alejandro Moreno argued that dual nationality does not imply ‘double loyalty’ and warned that the move would be a ‘significant setback for human rights and democracy.’ While Veracruz Governor Rocío Nahle supports the move for national sovereignty, legislative leaders such as Deputy Ricardo Monreal have noted that the proposal will require careful analysis by the Congress of the Union to ensure it respects constitutional rights.
