While previous estimates suggested up to half a million unregistered wells, newer assessments indicate there may be between 20,000 and 40,000 illegal wells across Poland. The amnesty aims to improve groundwater resource management and water-economic balances to better address drought conditions. However, legalization is not automatic; authorities will still review technical parameters and may order the liquidation of installations that pose a risk to water supplies. Wells with a depth of up to 30 meters used for ordinary water use remain exempt from permits if average daily withdrawals do not exceed 5 m³.

Parallel to water regulations, a draft bill known as ‘Lex smród’ is under public consultation. Supported by the Ministry of Agriculture and Rural Development, the proposal seeks to protect farmers from nuisance complaints by shifting the burden of proof to nearby residents.
