Brazil electoral harassment and propaganda irregularities

Overview

Brazilian judicial and labor institutions are intensifying efforts to combat electoral harassment and propaganda irregularities. The Ministério Público do Trabalho (MPT) has reported a massive surge in complaints during 2026. By early October, the agency recorded 884 complaints, representing a more than tenfold increase compared to the 85 cases reported during the same period in 2022.

Research by the Superior Labor Court (TST) and the Superior Council of Labor Justice (CSJT) indicates that digital platforms, particularly WhatsApp, are central to modern harassment. Harassment categories include psychological terror (81.9%), virtual methods (67.3%), and economic pressure (61.6%).

In response, labor courts have issued numerous injunctions across several states. In Bahia, courts ordered supermarket chains such as Total Atacado and Rede Mix to establish voting shifts and cease using branded apparel associated with political symbols. The municipality of Jacobina was also prohibited from pressuring public servants. In Rio de Janeiro, Grupo Zona Sul was ordered to clarify to employees that voting is secret and free from company influence. Following a complaint by the Retail Workers' Union, Judge Cláudia de Abreu Lima Pisco ruled that a letter sent by the supermarket criticizing the political landscape constituted electoral harassment, imposing a daily fine of R$ 500,000 for non-compliance.

Other judicial interventions include prohibiting companies in the beverage and construction sectors in São Paulo from using corporate communication channels for political promotion or hosting political events on-site. In Pará, the Regional Labor Court (TRT-8) reported 74 complaints and established a special duty roster to handle urgent requests regarding political intimidation in the workplace.
