Delhi riots UAPA bail hearings – Aug 2026

Overview

Since May 2026 Delhi courts have issued a series of bail rulings for activists accused under the Unlawful Activities (Prevention) Act in connection with the February 2020 northeast Delhi riots. An Additional Sessions Judge initially denied student activist Umar Khalid a 15‑day interim bail, while the Delhi High Court later granted bail to co‑accused Salim Malik and, on 22 May, a three‑day interim bail to Khalid for family reasons. The Supreme Court then referred the broader bail question to a larger bench and granted six‑month interim bail to two other accused. In June, Khalid and Sharjeel Imam filed regular bail applications, arguing that six years of pre‑trial detention without charge‑framing violated their liberty. The Karkardooma Court scheduled a hearing for 4 July. On that date, Additional Sessions Judge Sameer Bajpai rejected both applications, citing the binding Supreme Court order of 5 January 2026 that bars bail until protected‑witness examination or a one‑year period elapses, and noting that no charges have been framed. On 15 July the judge permitted Khalid two weekly video‑call contacts with his family, without changing his bail status. On 17 July the Delhi High Court Division Bench (Justices Prathiba M. Singh and Vikas Mahajan) issued a notice to police on Sharjeel Imam’s bail plea and scheduled further hearing for 27 August, noting recent Supreme Court interim‑bail orders for other co‑accused. On 30 July Khalid lodged a third appeal before the High Court, seeking regular and interim bail pending the Supreme Court’s final decision on whether prolonged detention can override the January 2026 restrictions. The court listed the matter for hearing on 27 August alongside Imam’s plea, with Khalid also urging interim bail pending a Supreme Court ruling on the applicability of Article 21 to Section 43D(5) of the UAPA.
