Jharkhand recruitment crisis: Protests and legal stays

Overview

The impasse between student protesters and the Hemant Soren government has escalated following the government’s decision to cancel numerous recruitment examinations conducted by the JPSC, JSSC, and the agency TSR Data Processing Private Limited (TDPL) since 2014. On August 18, the government moved to cancel 44 recruitment tests and ordered investigations by the CID and SIT into 23 other examinations.

In a recent development, the Jharkhand High Court maintained its stay on the state government's decision to cancel various recruitments, affecting candidates from the 11th to 13th JPSC, JSSC-CGL, CDPO, and Food Safety Officer examinations. Justice Deepak Roshan noted that while not all appointments can be considered entirely correct, cancelling thousands of appointments simultaneously would violate the principles of natural justice, stating the court cannot assume that “every single appointment was fraudulent.”

To oversee the Special Investigation Team (SIT) probe, the court appointed retired judge Gautam Kumar Chaudhary as the nodal officer. Candidates who feel they are being “unnecessarily harassed” during the investigation may submit complaints to him.

As investigations continue, the CID has arrested Rajan Kumar in Bihar, bringing the total number of arrests in the JSSC-CGL irregularities case to 11. To prevent future misconduct, the state announced structural reforms, including the formation of internal vigilance cells within the JPSC and JSSC, and a high-level committee led by IAS officer Amitabh Kaushal to study exam reforms. Meanwhile, student leader Devendra Nath Mahto of the JLKM continues the ‘Recruitment System Reform Yatra’ to demand a transparent process. Additionally, the High Court has ordered the state to appoint a new chairman and members for the JPSC within two months.
