SCOTUS removal ruling fuels EU‑US data challenge
Overview
The Supreme Court’s June 28‑30 2025 decisions dismantled the Humphrey Executor precedent, allowing at‑will removal of multi‑member commissions such as the FTC. A week later the Court extended that power to other independent agencies while preserving for‑cause protection for Fed Governor Lisa Cook. President Trump hailed the rulings; Justice Sotomayor warned of instability.
In early July 2026 the Court reaffirmed the removal precedent in a 6‑3 opinion, again citing the need for clear congressional authorization and again exempting Governor Cook. Austrian activist Max Schrems launched a case before the European Court of Justice, arguing that the FTC can no longer act as an independent overseer, undermining the EU‑US Data‑Privacy Framework.
On July 8 2026 the Court issued a 6‑3 ruling in *Trump v. Slaughter*, holding that the president may remove commissioners of independent agencies without cause. The decision further erodes remnants of the Humphrey Executor doctrine and weakens civil‑service protections meant to preserve merit‑based hiring.
Later in July, Schrems announced a fresh ECJ challenge, urging the European Commission to suspend the adequacy decision that permits EU‑US data flows. He warned that without an autonomous regulator the framework “rests on a shaky foundation” and called on firms to review transatlantic data transfers.
By July 21, the effort, dubbed “Schrems III,” had heightened legal uncertainty for European companies relying on U.S. cloud and AI services. Schrems pressed the Commission to withdraw the adequacy finding, while a short‑term block of Anthropic’s AI models for foreign users illustrated how regulatory actions could quickly restrict access. These developments deepen doubts about U.S. regulatory independence and intensify calls in Europe to reassess transatlantic data‑privacy arrangements.
