Overview

In late July 2026, libertarian commentator Markus Krall and left‑wing YouTuber Markus Brandmair publicly criticized the Alternative for Germany (AfD), urging the party to adopt more libertarian policies and mocking a hypothetical AfD dictatorship. Their remarks reflected growing concern over the AfD’s rising poll numbers and its perceived threat to democratic norms.

By early August 2026, the criticism moved from media commentary to formal legal action. Over 1,000 German lawyers, judges and prosecutors signed an open letter calling for a ban on the AfD, citing a legal opinion that the party’s policies violate human dignity and democratic principles enshrined in the German Basic Law. The signatories urged the Bundestag, Bundesrat or federal government to initiate a constitutional court procedure to declare the party unconstitutional.

On 3 August, the Republican Lawyers Association (RAV) issued the letter with 1 051 jurists signing. The signatories relied on a report from the Society for Civil Liberties (GFF) that analyzed more than three million data points and concluded the AfD’s programme breaches the human‑dignity guarantee and democratic order under Article 21 § 2 of the Basic Law. While some SPD members back the ban, most Union parliamentarians oppose it, and no formal request has yet been filed.
