Khyber Pakhtunkhwa Advocate General Shah Faisal Utmankhel raised legal objections regarding the court’s jurisdiction and the availability of alternative legal remedies through the Islamabad chief commissioner. The Attorney General further argued that the right to protest must not infringe upon the rights of other citizens and emphasized that public resources and officials should not be used for political demonstrations.

In a subsequent ruling, a larger bench led by Chief Justice Dogar disposed of the plea challenging the protest. The court ruled that no political party or leader has the lawful right to occupy public roads, highways, or buildings in a manner that obstructs access to medical facilities or educational institutions. The court issued a directive prohibiting the use of state resources for the march, mandating that provincial chief ministers ensure no public funds, official machinery, vehicles, or government equipment are used to facilitate the protest. Additionally, the court stated that no public servant should be compelled to participate in any rally or procession.
