Flybondi operational collapse and regulatory scrutiny
Overview
The Argentine low-cost carrier Flybondi continues to face a systemic operational and financial crisis. The airline has experienced significant service disruptions, including the cancellation of over 60% of scheduled flights during the winter holiday season. Operational downsizing has continued, notably with the cessation of its long-standing operations at Corrientes airport after more than eight years.
Financial instability persists as the company remains under pressure from judicial seizures related to ARCA tax debts exceeding 1.5 billion pesos. The judiciary has ordered an embargo on Flybondi’s bank accounts to settle these debts, following various private creditor filings for bankruptcy. While the airline has reactivated its website to resume ticket sales for travel starting in November to destinations such as Bariloche, Mendoza, and Asunción, travel agencies and consumer associations have raised concerns regarding the airline’s ability to guarantee these services.
Operational instability has worsened, with the airline canceling 80.5% of its scheduled flights in August, bringing its year-to-date cancellation rate to 22.8%. As part of an internal reorganization, Flybondi has dismantled its physical service counters at Aeroparque Jorge Newbery, shifting operations to digital platforms. The company is also implementing a restructuring plan to transfer employees to a new entity, OCA Air S.A., linked to businessman Marcelo Scatturice. Aviation unions have expressed concerns regarding potential “disguised outsourcing” and have requested intervention from the Ministry of Labor.
Legal and labor tensions remain high. The National Chamber of Labor Appeals recently invalidated a $32,500 promissory note that Flybondi required pilots to sign as a condition of employment. Judges ruled the requirement was incompatible with labor laws, noting the company failed to prove specific training expenses and that using such costs as an “economic threat” to ensure retention was improper.
