The NAACP has since joined the legal team to seek transparency. Civil rights attorney Ben Crump has expressed skepticism regarding theories of accidental drowning, stating, “The family does not trust Mississippi law enforcement to conduct a fair investigation for their Black son, who was found dead after boarding a boat with three young white males.”

As the family marked what would have been Wells’s 19th birthday with a prayer rally in Biloxi, Jackson County District Attorney Angel Myers McIlrath reiterated that no additional information can be released during the active probe. McIlrath noted that presenting evidence, including the state’s autopsy report, to a grand jury is standard procedure for suspicious deaths and does not inherently imply a crime occurred.

Legal tensions have escalated as attorneys for three of Wells’s friends—Morgan Seymour, Jax Pitalo, and Warren Hudson—issued a presuit defamation demand against Rev. Al Sharpton. The 19-page document alleges Sharpton falsely implied the men were involved in the death or obstructed the investigation. Sharpton has stated he is prepared to defend his comments in court.
