Spain advances disability and pension welfare reforms
Overview
Following the implementation of Real Decreto 416/2026 on August 28, Spain has introduced expanded flexible retirement options. Retirees can now return to the workforce part-time within a broader range of 33% to 80% of a standard jornada, with pension amounts generally linked to the level of work dedication.
Specific provisions for self-employed individuals (autónomos) allow them to engage in professional activity while retaining 25% of their recognized pension. To qualify for this fixed percentage, retirees must not have been registered as self-employed during the three years preceding their retirement. The reform further distinguishes between active retirement, which involves delaying pension access for a higher compatible percentage, and flexible retirement, which occurs after a pension has been granted.
Regional disparities and economic paradoxes persist. In Andalusia, the average pension remains approximately 1,432 euros, roughly 10% lower than the national average, with many retirees receiving amounts below the minimum wage (SMI). Economists continue to highlight a tension where high pension replacement rates—averaging 83.5% of the last salary—can exceed common worker salaries in a labor market characterized by minimum wage and part-time employment. Additionally, debates continue regarding early retirement penalties, which can reduce pensions by up to 21% based on contribution years and withdrawal timing.
